雖(sui)然鐘(zhong)(zhong)(zhong)點工(gong)(gong)是以(yi)(yi)小(xiao)時(shi)為(wei)計(ji)酬標準(zhun)的(de)一種用工(gong)(gong)形式,但應當注意的(de)是,并非以(yi)(yi)小(xiao)時(shi)計(ji)酬的(de)都是鐘(zhong)(zhong)(zhong)點工(gong)(gong)。《勞動(dong)合(he)同法》第68條規定:“非全日(ri)制用工(gong)(gong),是指以(yi)(yi)小(xiao)時(shi)計(ji)酬為(wei)主,勞動(dong)者(zhe)(zhe)(zhe)在同一用人(ren)單(dan)位一般平(ping)均(jun)(jun)每日(ri)工(gong)(gong)作時(shi)間(jian)(jian)不(bu)超(chao)過(guo)(guo)(guo)四小(xiao)時(shi),每周工(gong)(gong)作時(shi)間(jian)(jian)累計(ji)不(bu)超(chao)過(guo)(guo)(guo)二(er)十(shi)四小(xiao)時(shi)的(de)用工(gong)(gong)形式。”由(you)此(ci)可以(yi)(yi)看出(chu),鐘(zhong)(zhong)(zhong)點工(gong)(gong)與全日(ri)制用工(gong)(gong)相(xiang)比(bi),在待遇、保障等(deng)方面均(jun)(jun)有不(bu)小(xiao)的(de)差距。如(ru)果勞動(dong)者(zhe)(zhe)(zhe)平(ping)均(jun)(jun)每日(ri)的(de)工(gong)(gong)作時(shi)間(jian)(jian)超(chao)過(guo)(guo)(guo)4小(xiao)時(shi),或者(zhe)(zhe)(zhe)每周工(gong)(gong)作時(shi)間(jian)(jian)累計(ji)超(chao)過(guo)(guo)(guo)24小(xiao)時(shi),則勞動(dong)者(zhe)(zhe)(zhe)可向(xiang)用人(ren)單(dan)位提出(chu)建立全日(ri)制用工(gong)(gong)關系。
